Who needs to carry out a fire risk assessment?


All employers are required by law, The Regulatory Reform (Fire Safety) Order 2005 or The Fire (Scotland) Act 2005 to carry out a fire risk assessment. Where there are 5 or more employees then that risk assessment has to be recorded. Under the Regulations the company is the responsible person but if you manage a premises on behalf of your company then you are listed as having responsibilities as well. This applies to all but single private dwellings so therefore the common areas of flats and apartments are required to comply. You can do this yourself, but you would have to take on the responsibility of completing a full survey of your building and providing a suitable and sufficient fire risk assessment.
